Regulating AI in a Data-Driven Defence Landscape

In defence we exploit data and knowledge as an effective deterrent and weapon in equal measure, now a very real threat to those data sources and intelligence sharing agreements exists.


The rapid adoption of Generative AI (GenAI) tools like OpenAI’s ChatGPT has revolutionised how organisations generate, consume and process information. But behind the innovation lies a growing concern: Who owns the data used to train these models? And how can creators, organisations, institutions and thought leaders protect their intellectual property in an age where digital content can be scraped, replicated and reused at scale?


This article (based on a dissertation submitted for an MBA) explores the intersection of copyright protection, data protection regulation and GenAI technologies. It outlines how secondary research was used to investigate the legality and ethics of using publicly available content for training large language models (LLMs) and proposes practical recommendations to enhance accountability in the AI sector.
